Etsy enforces the part of compliance it can see: what your listing says. Federal cosmetic law has been rewritten since most advice on this topic was published, with the Modernization of Cosmetics Regulation Act now carrying registration, listing, safety substantiation and adverse event duties, and the FDA recording 16,398 active facility registrations and 1,298,361 active product listings as of 30 June 2026.
We read the FDA's labeling summary, its cosmetic-drug-soap classification guidance and its registration pages against Etsy's own Medical Claims and Cosmetics Ingredients policies, then mapped each duty onto the thing that actually happens to a seller: a listing that disappears. This is the enforcement version, not a formulation course.
Etsy Cosmetics Rules Start With Your Listing, Not Your Recipe
Every argument about cosmetics compliance starts in the wrong place, with ingredients. The classification that decides which law applies is set by intended use, and intended use is evidenced by what you say the product does.
The FDA defines a cosmetic as an article applied to the body "for cleansing, beautifying, promoting attractiveness, or altering the appearance". A drug is an article intended for diagnosing, curing, mitigating, treating or preventing disease, or intended to affect the structure or any function of the body. One product can be both, which is why antidandruff shampoo, fluoride toothpaste, antiperspirant deodorant and a moisturiser with SPF are all regulated as drugs as well as cosmetics.
Soap has its own carve-out at 21 CFR 701.20 and leaves FDA jurisdiction entirely. That matters on Etsy, because the exemption is fragile in exactly the way a listing description is.

The product never changed. Six of those eight rows are the same three items, and a sentence moved them between regimes.
The Claims That Get Etsy Listings Removed
Etsy's Medical Claims policy is short and unusually blunt. It prohibits items intended for the treatment or prevention of an illness or health condition, or for affecting the structure or function of the body, and it applies to claims made anywhere in the shop or listing, including the title, description, tags and images.
Two parts catch sellers who believe they are careful. The first is that a disclaimer is not an acceptable workaround. "These statements have not been evaluated by the FDA" underneath a claim that a balm treats psoriasis does not neutralise the claim, it documents it. The second is images. A photograph of your label, an infographic in the fourth listing image, a customer review pasted into the gallery: all of it is listing content and all of it is reviewable.
The FDA's warning letters to small skincare businesses are the best available list of phrasing that fails, because they are phrases regulators have already objected to in writing.

The right hand column is not a loophole. It is the actual boundary of a cosmetic claim: appearance, feel, scent and cleanliness. If a sentence describes what the product does to a condition rather than to an appearance, rewrite it. The same principle governs every other kind of listing deactivation, where the words rather than the goods are what the reviewer sees.
Etsy's Cosmetics Ingredients Rule Is Separate From the FDA's
Sellers often assume that passing FDA ingredient rules is the whole test. Etsy maintains a Cosmetics Ingredients policy of its own that prohibits certain ingredients in any amount, on top of whatever federal law allows.
The platform bans, among others, para-phenylenediamine in products for direct skin application, which is what "black henna" temporary tattoo kits contain, along with hydroquinone skin lighteners and bimatoprost lash products. Colour additives not FDA-approved for cosmetic use, or not approved for the specific type of cosmetic you are selling, are prohibited as well. A colourant cleared for a bath bomb is not automatically cleared for a lip balm, and the eye area has its own approved list. Federal law separately restricts or prohibits bithionol, mercury compounds, vinyl chloride, chloroform, methylene chloride and hexachlorophene in cosmetics.
The documentation clause nobody reads. Etsy's cosmetics policy reserves the right to request documentation to assess compliance, and to remove listings when it is not satisfied. In practice that means a supplier certificate of analysis, an ingredient breakdown, or evidence of a colour additive's approval status. Sellers who cannot produce anything within the response window lose the listings by default rather than on the merits. File supplier documents by batch before you are asked.
What Has To Be On A Cosmetic Label
A cosmetic that is not labeled correctly is misbranded, and a misbranded cosmetic is illegal to sell regardless of how safe it is. This is the most common gap in handmade shops, because a label designed for a craft fair is usually missing two or three mandatory elements. The requirements split across two panels: the principal display panel a buyer sees on the shelf, and the information panel for everything else.

Two details save redesign work. Ingredients present at one percent or less, and colour additives, may be declared without regard to predominance, so the order only has to be strict at the top of the list. And where a package surface is under 12 square inches and the product sits in a tightly compartmented tray rather than a folding carton, 21 CFR 701.3(i) permits the ingredient declaration off the package.
The last row is the newest and most frequently missed. MoCRA requires a domestic address, domestic phone number or electronic contact through which you can receive adverse event reports. An email address or a contact page URL satisfies it. A label template bought in 2022 does not.
MoCRA: Register, List, and the Exemption That Probably Isn't Yours
MoCRA added two administrative duties. Facilities that manufacture or process cosmetics must register with the FDA and renew biennially, with new facilities registering within 60 days of first manufacturing and any change filed within 60 days. The responsible person must list each marketed product with its ingredients within 120 days of first marketing it, and update annually. Both are free, through the FDA's Cosmetics Direct portal. If you make lip balm in a spare room, that room is the facility. There is no minimum size.
There is a small business exemption: average gross annual US cosmetic sales below $1,000,000 over the previous three years removes the registration, listing and good manufacturing practice duties. Most handmade shops are comfortably under it, which is why the figure gets quoted so often and the carve-outs so rarely.

A shop selling one handmade eyeshadow alongside forty bath products is outside the exemption for the whole facility. That is the trap, and it is what every general MoCRA explainer written for brands leaves out, because brands with a million dollars in sales never needed the exemption.
Three duties have no exemption at any revenue: labeling, safety substantiation and adverse event reporting. A serious adverse event must be reported within 15 business days of learning of it, new medical information received within a year must be filed within another 15 business days, and records are kept for six years, reduced to three for small businesses.
One 2026 clarification is worth banking. On 9 September 2026 the FDA stated that it does not provide certificates verifying compliance for cosmetic facility registration. If a reseller or stockist asks for your "FDA certificate", no such document exists, and anyone selling you one is selling you nothing. The portal added REGISTRATION STATUS and RENEWAL DATE fields in February 2026, which is where you check your own standing.
Soap Is Exempt Until Your Listing Copy Says Otherwise
The soap exemption is the best deal in this area and the easiest to lose. Under 21 CFR 701.20 a product is soap, regulated by the Consumer Product Safety Commission rather than the FDA, when all three of these hold: the bulk of the non-volatile matter consists of an alkali salt of fatty acids, the detergent properties are due to those compounds, and the product is labeled, sold and represented only as soap.
The third condition is the one Etsy sellers break. Claiming the bar moisturises, deodorises or makes the buyer smell good is a cosmetic claim, and the product becomes a cosmetic with a full label. Claiming it treats acne or kills germs makes it a drug. Adding synthetic detergents can move it out of the exemption even if the listing still says soap. In practice, almost every handmade "soap" listing that mentions moisturising is selling a cosmetic and labeling it as soap.
Genuine soap needs no ingredient declaration, which is why the distinction is worth preserving deliberately rather than by accident. It remains subject to the Federal Hazardous Substances Act, so a product meeting the definition of a hazardous substance carries precautionary labeling regardless.
Supplements Are a Different Regime, and the Clock Runs Out on 31 December
The FDA regulates dietary supplements as food. A product taken by mouth containing vitamins, minerals, herbs or other botanicals, amino acids, enzymes or other dietary substances is a dietary supplement whether or not you call it one. Selling a herbal tincture as "wellness drops" does not change the regime it falls under.
The label requirements differ from cosmetics: the name of the supplement, net quantity, nutrition labeling in the Supplement Facts format, an ingredient list, and the name and place of business of the manufacturer, packer or distributor. Disease claims are prohibited outright, and current good manufacturing practice is the seller's responsibility to establish and follow.
Then there is the date. Facilities that manufacture, process, pack or hold food, which includes supplements, register with the FDA and renew biennially in even numbered years only. The 2026 window opens on 1 October.

Whether you need to register at all is genuinely unsettled for small direct sellers, and worth settling before October rather than in January. Establishments whose primary function is selling food directly to consumers are "retail food establishments" and exempt, and the FDA's 2016 rule confirmed the point of sale does not have to be in person. A maker whose sales are overwhelmingly direct to Etsy buyers has a real argument for the exemption. A maker who also wholesales to shops probably does not, and if a co-packer manufactures for you, that co-packer's facility must be registered regardless of your own status.
When a Removal Becomes a Suspension
A single removed listing is an administrative event. Etsy deactivates it, sends a notice, and the shop trades on. What changes the picture is pattern. Repeat violations of the same policy, particularly medical claims across many listings, are read as a shop-level problem, and the sequence tightens. Sellers who bulk-copied a description across sixty listings are the classic case, because one bad sentence is present sixty times and gets found in a single sweep.

A Pre-Listing Check That Takes Ten Minutes
Run this before publishing in this category, and once across your back catalogue, because that is where the 2023 tag you forgot about is sitting.
- Search your own shop for disease words. Eczema, psoriasis, acne, dandruff, arthritis, anti-inflammatory, antibacterial, antifungal, healing, cure, remedy, detox. Check titles, descriptions, tags and the text inside images.
- Decide soap or cosmetic deliberately, then label consistently with that decision across every listing for the product.
- Check the label against the eight rows above, especially the adverse event contact and the business address.
- Confirm your colour additives are approved for the specific product type, not just for cosmetics generally.
- Work out whether any product crosses a MoCRA carve-out, because one eye product removes the exemption for everything.
- If you sell ingestibles, diary 1 October 2026 and settle the retail food establishment question before it.
This is the discipline that keeps shops out of trouble on children's product rules and EU compliance requirements: the enforcement is automated and text-driven, so the audit has to be too.
Frequently Asked Questions
Do I need FDA approval to sell cosmetics on Etsy?
No. Cosmetics other than colour additives do not require FDA premarket approval. What you do need is a compliant label, adequate substantiation that the product is safe, and no drug claims.
